Fatal ambush trial at Ogden Store in 2019 | dishes

OGDEN – A trial is slated for September of an Ogden man accused of fatally shooting the ex-husband of a woman he dated.

Everardo Guadarrama-Garcia appeared on video link in the 2nd District Court on Tuesday, where lawyers and judge Noel Hyde upheld the trial for September 13-20.

The 25-year-old has been held without bail in Weber County Prison since his arrest on May 18, 2019, in which Mauricio Alejandro Hernandez was killed.

The trial was originally scheduled for February 2 of this year, but social distancing and other COVID-19 restrictions have forced the postponement of murder and other first-degree crime trials. However, trial planning has resumed as court officials expect restrictions to be relaxed.

Hyde has scheduled another pre-conference for June 1st.

Weber County prosecutors and Ogden police said Guadarrama-Garcia ambushed Hernandez, 24, as he walked to the entrance of a grocery store on 31st Street’s 500 block.

Based on surveillance videos and testimony, prosecutors say Guadarrama-Garcia fired multiple shots at Hernandez and ran home.

Hernandez suffered 45-gauge gunshot wounds to the head, neck, chest and abdomen, according to a report by a medical examiner.

“I killed your husband,” Guadarrama-Garcia allegedly said in a text message to Hernandez’s ex-wife. The woman told police she started dating Guadarrama-Garcia after her relationship with Hernandez ended.

Guadarrama-Garcia is charged with murder of first degree crimes, second degree crimes obstructing justice, serious third degree crimes and the use of a third degree firearm by a disabled person.
