Zagarella trial, Ogden: next hearing for Thursday 29 July | news

LOWELL – The upcoming trial of the two suspects related to the death of Ethan Costello in October 2016 could face further delays.

Joseph Zagarella, 21, is charged with manslaughter and Thomas Ogden, 54, is charged with providing alcohol to minors and consuming alcohol on his property.

The victim, Ethan Costello, 15, was fatally injured while attending a party at Ogden’s Belvidere residence in Lowell, allegedly after a physical confrontation with Zagarella.

The original trial date for this trial was set for November 2018, but after several delays and continuations, the trial is now set to begin on August 9, 2021, but another motion to continue has been filed.

Previously, the Town Crier reported that court documents said the pre-trial conference had been postponed to November 2022. These documents related to a separate ongoing civil case.

A hearing on the motion to continue the criminal proceedings will take place on Thursday, July 29, 2021.

Middlesex County Prosecutor’s Office officials said some of the delays in the case were due to a change in defense attorney.

COVID-19 has also impacted the delay in this process as legal proceedings have only recently resumed and the courts are still limited in scope.
